2. Description of Services

Milky Way Apps is a distributor of promotional gaming systems. Our services include:

  • Information and distribution of gaming software platforms (Fire Kirin, RiverSweeps, Milky Way Apps, Orionstar, and others)
  • Points/credits issuance for gaming systems
  • Technical and customer support for gaming system operators
  • Business consulting for gaming system setup and operation

We act as a distributor and do not directly operate, manage, or control any gaming system once it is deployed to our clients.

3. Eligibility

Our services are available only to individuals and businesses that:

  • Are at least 18 years of age
  • Have the legal authority to enter into binding agreements
  • Comply with all applicable local, state, federal, and international laws and regulations
  • Are legally permitted to operate promotional gaming systems in their jurisdiction

It is the customer's responsibility to ensure that their use of gaming systems complies with all applicable laws in their territory. We strongly recommend consulting with legal counsel before operating any gaming system.

4. Account and Registration

To use our services, you may be required to create an account or register as a distributor. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your information to keep it accurate
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

5. Payment and Billing

Services and points/credits are subject to the following terms:

  • All prices are subject to change without prior notice
  • Payment is due as agreed upon at the time of order
  • We accept multiple payment methods as outlined during the ordering process
  • Volume discounts may be available and will be communicated during your consultation
  • Points/credits are issued within 30 minutes during business hours after payment confirmation

All sales of points/credits are final once issued. Refunds are handled on a case-by-case basis at our sole discretion.

6. No Warranty on Gaming Systems

IMPORTANT: The gaming systems we distribute are developed and maintained by third-party software providers. While we strive to recommend reliable systems, we do not guarantee:

  • The availability, uptime, or performance of any gaming system
  • The accuracy or completeness of game outcomes
  • The revenue or profitability of any gaming system for your business
  • That gaming systems will meet your specific requirements

All software products include multiple compliance settings. It is solely the customer's responsibility to ensure proper system settings and lawful use in their jurisdiction.

7. Compliance and Legal Responsibility

Promotional gaming systems are subject to varying regulations depending on your jurisdiction. You acknowledge and agree that:

  • You are solely responsible for ensuring compliance with all applicable laws and regulations in your area
  • You will consult with qualified legal counsel before deploying or operating any gaming system
  • Milky Way Apps does not provide legal advice and is not responsible for your regulatory compliance
  • Different compliance settings (Skill mode, Pre-Reveal, etc.) must be configured according to your legal counsel's advice

8. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, software, and design elements, is the property of Milky Way Apps or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Reproduce, distribute, or create derivative works from any content on this site
  • Use our brand name, logo, or trademarks without written permission
  • Scrape, crawl, or use automated tools to extract content from this site

9. Limitation of Liability

To the fullest extent permitted by law, Milky Way Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to:

  • Your use of or inability to use our services
  • Any unauthorized access to or alteration of your data
  • Any errors, mistakes, or inaccuracies of content
  • Personal injury or property damage arising from your use of gaming systems
  • Any interruption or cessation of our services

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Milky Way Apps, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or relating to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your operation of gaming systems in your jurisdiction

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the services will cease immediately. Any outstanding balances or obligations shall survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Cheyenne, Wyoming.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Cheyenne, Wyoming, in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Milky Way Apps regarding the use of our services and supersede all prior agreements and understandings.
